NFFE and Coalition Unions Victorious in Executive Order Lawsuit Against Trump

U.S. District Judge Ketanji Brown Jackson ruled that provisions challenged within the Executive Orders violated statutory law-- ordering further implementation to cease, and for the removal of any effects to the now invalid provisions. NFFE originally filed suit on June 13.

Washington, D.C. – Late Friday, the National federation of Federal Employees (NFFE) and a coalition of 12 other federal unions won a challenge in federal court after petitioning to strike down provisions in three Executive Orders issued by President Trump on May 25, 2018.  A federal judge in the U.S. District Court for the District of Columbia ruled that President Trump exceeded his authority when he issued the Executive Orders (EO) covering federal employee collective bargaining, grievance procedures, and official time.  

“It is clear from the decision that the court found overwhelmingly that President Trump overstepped his authority when he issued the Executive Orders,” stated Suzanne Summerlin, NFFE Associate General Counsel and Lead Counsel for the coalition lawsuit. “Federal employees can return to work on Monday knowing that their rights are intact, and that presidential overreach targeting career civil servants was curbed.”  

The decision was rendered about two months after the union coalition filed a lawsuit against President Trump and the Office of Personnel Management (OPM), seeking an injunction from the court to block further implementation of the orders.  U.S. District Judge Ketanji Brown Jackson ruled that provisions challenged within the Executive Orders violated statutory law, and ordered the ‘President’s subordinates in the Executive Branch’ to stop further implementation and remove any effect of the now invalid provisions.  

“Today is a great day for federal employees and unions across the county,” stated NFFE National President Randy Erwin. “We stood firm together against three horrible, politically motivated Executive Orders that attempted to rob federal employees of their right to representation in the workplace.  This is more than a victory for federal employees.  This is a victory for the rule of law, the Constitution, and legitimate checks and balances between the branches of government.  The American people should feel proud about what was accomplished today.”
